Labour law plays an important role in both promoting Decent Work and responding to current social and economic challenges.

  • It is the concrete expression of fundamental principles and rights at work.
  • It establishes a regulatory framework that guarantees transparent and consistent processes and expeditious and reliable decision-making on issues relating to labour and employment relations in both the private and the public sector.
  • It provides a normative basis on which employers, workers and their representatives can interact with one another and with governments and therefore serves as an important instrument in promoting industrial and workplace democracy.

The ILO's constitutional obligation to provide technical cooperation and advisory services in support of the ratification and implementation of ILO Conventions may include assistance in the development of national labour laws and regulations, and law enforcement machinery. ILO advice in this field focuses on the adoption of labour laws which:

  • reinforce basic human rights;
  • regulate the employment relationship in ways that balance the need for both social equity and economic efficiency; and
  • provide an adequate framework for representation, collective bargaining, dispute resolution and effective social dialogue and tripartite consultation.

ILO assistance also aims to develop the capacity of workers' and employers' organizations and labour ministries in this field including:

  • the ability to understand different approaches to the formulation of labour laws and select the most appropriate approach having regard to the national context and priorities,
  • the ability to draft and implement labour laws, and
  • procedures for settling disputes on the interpretation and application of labour laws.
