    2. Non-business units of the State, non-business units of political organizations and socio-political organizations;

    Provides that a labour contract is an agreement between an employee and an employer in respect of a paid job in which both parties agree to conditions of employment, the working conditions to be provided and the rights and obligations of each party. Labour contracts apply to organizations and individuals from various economic branches and sectors which employ and hire labour, and to hired employees who are to be paid wages (excludes persons elected to public office, persons appointed to positions in the State apparatus and in State-run economic units, military personnel and persons employed by State administrative bodies or work units). Includes provisions on conclusion of labour contracts, implementation of, changes to, deferment of and termination of labour contracts, settlement of labour disputes and action on violations.

    Covers recruitment of local manpower and of foreign technicians where local skills are not available, employment contracts, collective agreements, working time, leave, rest, wages, social insurance, employment accidents, occupational diseases and occupational safety, environmental protection, trade union rights, labour inspection and labour disputes. Foreign agencies, enterprises and companies already established are required to bring the conditions of employment of their Vietnamese workers into conformity with the Statute within three months of its promulgation. Guide-lines on the implementation of the Statute were made on 26 May 1990, together with a standard employment contract model.
