    This Law provides for the establishment of unemployment insurance and social security for Kuwaiti employees in the private, oil and gas sectors in case of their dismissal.

    Eligibility is limited to Kuwaiti nationals who must be:

    1. Between 18-60 years old.
    2. Capable of working.
    3. Not entitled to receive a pension.
    4. Have been employed for at least six months from the application date of the Unemployment Insurance Law.

    Under the Unemployment Insurance Law, employees are entitled to 60% of their last monthly salary for a period of six consecutive months following unemployment, whether in the case of resignation or termination.

    Both the employer and the Kuwaiti employee must each contribute to this social insurance fund. Pursuant to the Unemployment Insurance Law, each Kuwaiti employee and his employer shall owe a monthly contribution of 0.5%; in addition, the public Treasury will also contribute 0.5%.

    The Unemployment Insurance Law sets out certain instances where unemployment insurance benefits can be suspended or not granted altogether including but not limited to the following instances: (i) the insured has rejected a job that is suitable for him (suitability is to be determined by the Minister of Finance); (ii) the insured refused to join a training course as required by the Manpower and Government Restructuring Program; and (iii) the insured has a private business.

    This law repeals all provisions that are inconsistent with this law.

    This law enters into force on the first day of the month following its publication in the official Gazette.

    Section 1: Section 2 of Social Security Act, No. 61 of 1976 is replaced as follows: "The maximum monthly pension payment is raised from 1250 DK to 1500 DK".

    Section 2: The second paragraph of Section 23 of the Social Security Act is replaced as follows:
    "Social insurance contribution payment will be stopped when the calculated contribution period of the insurance has reached the amount required for the eligibility for the maximum pension payment as mentioned in the paragraph 7.
    The suspended social insurance contribution payment shall continue even when the insured has taken up new employment and after finds him/herself outside the provisions of the scope of application of this chapter.
    The social contribution payment shall be returned to the insured if he/she did not take advantage from such contribution".

    Section 4: Section 26 is added to the Law No. (25) of 2001 amending certain provisions of the Social Security Law and Pensions Increments:
    "The pension payments shall be readjusted for those whose work ended in the periods between 20/05/2001 and 31/01/2003 in the non-governmental sectors which applies Section 3 of Law No. 19 of 2001 regarding the national labour support and encouragement to work in non-government sectors which is based on increasing the social allowance and the children beneficiaries to the pension payment at the end of the insured work and upon which the pension settlement is based.
    Furthermore, the pension payments shall be readjusted, in circumstances where service in the mentioned sectors is ended in the periods between 20/05/2001 and 17/08/2002, as based on the previous paragraph, supposing the validity of the rules that decides the eligibility for the two allowances is after the last date in accordance to Law No. 19 of 2001 as mentioned above".

    Section 5: The first paragraph of Section 4 of Law No. 128 of 1992 is replaced as follows:
    "The supplementary insurance fund is added to the social security funds, its resources are explained in this section".

    Section 9: Section 5 and Section 6 of Law No. 25 of 2001 are replaced as follows:

    "Section 5: The pension and the supplementary payment shall be readjusted at the marriage of the pensioner, who was not entitled to social allowance for his wife at the end of his contribution, assuming his eligibility to the social allowance according to the provisions of law No. 19 of 2001 regarding the national labour support and encouragement to work in non-government sector, and supposing that his contribution continued at the date of his marriage, and he was entitled to the social allowance from his wife in the calculated contribution period for the pension payment, the pension increase resulting from the readjustment will start from the first next month of the marriage date."

    "Section 6: The monthly pension payment shall be increased up to 50 DK for every child who is born after the end of the pension contribution and after the date 29/02/1992 if the pensioner meets the conditions of such benefit according to the requirements of Law No. 19 of 2001 regarding the national labour support and encouragement to work in non-government sector."

    Section 11: The first paragraph of Section 9 of Law No. 25 of 2001 is replaced as follows:
    "The monthly pension payments shall be increased every three years by the amount of 30 KD effective 1/08/2010."

    Section 1: Kuwaiti or non-Kuwaiti working mothers are entitled to a special leave with full pay when they accompany a sick child to hospital.

    Section 2: Child's age is not required in this condition, however, it shall be determined in the light of the child's situation and the necessity of his/her mother's presence, which must be proven by medical report certified by the Ministry of Health.

    Section 3: This Order enters into force once it has been published in the official Gazette. Paragraph (c) of the Civil Service Council Order No. 1 of 1993 is repealed.

    Section 1 of Order No. 8 of 2011: Section (1) and Section (2) of Order No. 13 of 1979 concerning regulations and provisions on special leave are replaced and amended, which establishes that employee may be granted special leave without pay for 6 months to 3 years, during entire service period, provided that he or she is Kuwaiti citizen and has been in government's service for a continuous period of no less than 5 years and is at least 50 years old. Working mother shall be entitled to a special Leave for 6 months to 4 years according to the following requirements: (a) Kuwaiti married employee or non-Kuwaiti employee who is married to a Kuwaiti; or (b) Kuwaiti widowed or divorced employee with children, or non-Kuwaiti widowed or divorced employee with Kuwaiti children, provided that she had completed successfully her trial period.

    Section 3 of Order No. 13 of 1979 concerning regulations and provisions on special leave is repealed.

    Section 1: Subject to provisions of Law No.6 of 2010 concerning working in the private sector:
    a) Employers in the private sector are prohibited to use any mean making workers executing forced labour, or forcing workers to carry out tasks outside their assigned job.
    b) Subject to the previous paragraph, employers are prohibited to employ workers without pay.
    c) Employers are permitted, within the limits of the law and and the Ministerial Order No. 188 of 2010, to require workers to work overtime.

    Section 2: Subject to Section 141 of the Law No. 6/2010 or to any greater penalty stipulated by another Law, the Ministry may stop the employer's file permanently or temporarily if he/she violates the provisions of this Order.

    Section 3: The provisions of this Order do not apply to acts for which a court ruling has been issued and implemented under the supervision of the Public Authority.

    Section 4: This Ministerial Order enters into force once it has been published in the Official Gazette.

    Order No. 6 of 2011 deals with the conditions and rules concerning the entitlement to retirement pensions for care givers of disabled persons. In this regard, the insured person or the beneficiary who takes care of someone with a moderate or severe disability is entitled to retirement pension payments, if they have an accumulated service period of at least 20 years for men and 15 years for women. The caregiver must be a Kuwaiti citizen or have a Kuwaiti mother.

    Regulates procedure of granting ministry employees special parental, maternity or child-care leave without pay, as stipulated in Order No. 13 of 1979 of the Civil Service Council. To be eligible for special maternity or child-care leave, employee must have at least 3 years of service. Employee is entitled to maternity leave after maximum of 1 year after termination of delivery leave. Employee must not have undergone disciplinary sanctions during preceding year. Also sets forth some additional requirements.
