    Amendments to section 3 ("a" GCC citizens exempted from requirement of ministerial authorization for employment of foreigners; "b" employers to bring foreign workers into Kuwait only if they themselves actually need them and employ them); section 11 (regulation of the establishment and operation of authorized employment agencies; probibition of fee-charging with respect to workers recruited), and section 97 (employers acting in breach of the Code to be warned in writing and, failing remedial action within a specified period, fined between 100 and 200 Dinars per worker affected; penalty doubled for recividism). Under a new section 97 bis, violations of section 3(b) are punishable by imprisonment for up to 3 years and/or a fine of up to 5000 Dinars.

    This Order amends section 14 of Ministerial Order No. 106 of 1994 to provide that employers are responsible for their workers and that no worker may transfer to another employer within the first two years of his employment except in the event of bankruptcy, merger, etc, or against payment of the prescribed tax.

Other provisions temporarily authorize the transfer of workers from one employer to another (a reference to the system of sponsorship) and require that employers applying for work permits must henceforth submit copies of the contracts of employment they have concluded with the workers they propose to hire.

Private sector employers must provide a financial guarantee ranging from 150 to 250 Kuwaiti dinars per worker - depending on the size of the enterprise - which the Ministry may foreclose in full or in part if the employer commits a breach of labour law, particularly if he fails to pay his workers on time or fails to send them back to their country on expiry of their contract of employment.

    An Order of the Minister of Internal Affairs to specify conditions of eligibility for a domestic service agency license and various other matter concerning the application of Legislative Decree No.40, 1992. Licensed agents are responsible for bringing domestic servants to Kuwait (usually from Asia) under a contract concluded with the prospective employer. The employer must pay the agency's commission and the servant's travel expenses, but if he is dissatisfied, the servant is repatriated at the agent's expense. Two model contracts are published at the end of the Order: the first is the contract of agency and the second, a contract of employment to be concluded between the employer and the servant. However, it is unclear whether these contracts are an integral part of the Order.

    Stipulates that a foreigner employed in the public sector can be joined in Kuwait by his wife and up to three children, provided that he earns at least 450 dinars per month. Foreigners working in the private sector can be joined by their wife and two children, but they must earn at least 650 dinars per month and pay an annual tax of 100 dinars per family member. Foreigners in either category can bring over more than the prescribed number of children if they pay an additional annual tax per child.

Enonce les conditions et formalités à remplir à cet effet.

    Prévoit notamment que les cotisations dues par les travailleurs soumis à la loi No. 11 de 1988 sont calculées à raison de 15% du salaire soumis à l'assurance.     Permits GCC citizens and corporations to engage in such economic activities as investigation (including scale evaluation), and mechanical works in accordance with the law governing these activities in Kuwait. GCC citizens may set up companies to engage in these activities and may hold shares in them in accordance with the law. They may also obtain permits for their foreign employees (priority must be given to fellow GCC citizens).

    Stipulates that a residence permit becomes invalid if the holder has been absent from Kuwait for more than six months. Exemptions from this rule include students, patients whose conditions require treatement abroad, and employees whose duties require absence from Kuwait for more than six months. Permission to be absent should be sought and obtained by those exempted. Written and certified evidence must be submitted.
