    This Law amends Section 51 of Law No. 6 of 2010 concerning Labour in the Private Sector, which states that Kuwaiti nationals are entitled to full indemnities at the end of their service without employers deducting sums from their salaries to pay for the Public Authority for Social Security subscription. Indemnities will be paid in full by the current employer at the end of their service retrospectively actively from the date of Kuwait Law No. 6/2010 being implemented.

    This Law amends and replaces Articles 51 and 70 of Law No. 6 of 2010 regarding Labour in the Private Sector.

    Article 51, deals with end of service gratuity payments and their relationship with pension contributions. The Amending Law states that upon ending his/her service, an employee is entitled to a full/complete end of service gratuity payment without deducting pension contributions made by the employer towards the Public Institution for Social Security.

    Article 70, deals with annual leave entitlements for employees. The Amending Law stipulates that “an employee has the right to 30-days’ paid annual leave in the first year of service provided that he has completed at least six months with the employer. Weekend holidays, public holidays and sick leave days shall not be counted as part of annual holidays.”

    Law No. 30 of 1995 to amend certain provisions of the Private Sector Labour Code (Law No. 38 of 1964)

    Amendments to section 3 ("a" GCC citizens exempted from requirement of ministerial authorization for employment of foreigners; "b" employers to bring foreign workers into Kuwait only if they themselves actually need them and employ them); section 11 (regulation of the establishment and operation of authorized employment agencies; probibition of fee-charging with respect to workers recruited), and section 97 (employers acting in breach of the Code to be warned in writing and, failing remedial action within a specified period, fined between 100 and 200 Dinars per worker affected; penalty doubled for recividism). Under a new section 97 bis, violations of section 3(b) are punishable by imprisonment for up to 3 years and/or a fine of up to 5000 Dinars.

    Consists of 15 Chapters and 98 articles. Chapter I provides for scope of law's implementation. Chapter II concerns migration and work permit. Chapters III and IV deals with employment and contracts. Chapters V and VI regulate employment of juveniles and women. Chapters VII and VIII govern wages and hours of work and leave. Chapter IX concerns working conditions. Chapter X deals with work regulation and penalties. Chapter XI regulates expiry of labour contracts and terminal indemnity. Chapter XII provides for compensation for labour accidents and industrial diseases. Chapters XIII and XIV regulate organisations of labourers and employers, and conciliation and arbitration of collective labour disputes. Chapter XV deals with general matters. This Law supersedes the Private Sector Labour Law of 1959, the Amiri Decree No. 43 of 1960 and Law No. 1 of 1961.
