Abstract/Citation
The Maritime Code regulates the relations connected with navigation. The term "navigation" means utilization of vessels for transportation of passengers, cargo, post, fishing vessels and other marine industries, prospecting and extraction of minerals, towing and life-saving operations and other economic, scientific and cultural purposes. This Code governs marine, fluvial and lake navigation, and navigation in other waterways. The following vessels shall be authorized to fly Georgian national flag: (a) vessels pertaining to the state property of Georgia; (b) vessels pertaining to the property of Georgian legal or natural persons; (c) vessels owned by foreign ship owners that have representative in Georgia with full plenary powers; and (d) vessel hired in accordance with bareboard charter contract. Vessels shall be registered at the State registrar of shipping. Seaports shall have harbour administration subordinated to the Marine administration of Georgia. Owner of vessel shall be responsible for dumping at sea and marine pollution from ship. The Code establishes that fishing vessel is a ship used for fisheries, hunting and harvest of marine biological diversity. Integral part of fishing vessel is fishing gear which damage by another vessel shall be considered accident (art. 13). In conformity with the present Code vessel shall be considered any vessel, including fishing vessel registered in the seaports of Georgia (art. 15). Fishing vessel must have international safety certificate. This provision does not apply to the following vessels: 1) fish processing vessels; 2) scientific research vessels; 3) transportation of fish (art. 39). Master of seaport shall exercise the functions regarding supervision over safe navigation and observance of international conventions, laws and regulations of Georgia by fishing vessels irrespectively of the flag they are flying (art. 80).
