Abstract/Citation: Makes amendments to the Criminal Code Act 1995 and the Migration Act 1958 which regulate penalties against persons who smuggle people. With respect to the Criminal Code, section 73 is modified to provide for the offence of people smuggling and adds a new section 73.3A concerning supporting the offence of people smuggling for those who provide material support or resources to offenders. The Migration Act is amendments by repealing Subdivision A of Division 12 of Part 2 and inserting a new Subdivision A concerning people smuggling and related offences. Makes consequential amendments to a number of other Acts:
- Proceeds of Crime Act 2002
- Surveillance Devices Act 2004
- Telecommunications (Interception and Access) Act 1979
- Australian Security Intelligence Organisation Act 1979
