Second Region

Made under Employment and Industrial Relations Act. Applies to transfers of undertakings and businesses to another employer. Establishes that, in the event of tranfers, articles 38(1) and (3) of the Act shall apply in relation to employees' rights to old age, invalidity or survivors' benefits under supplementary company pension schemes outside provisions of Social Security Act. Also provides for safeguarding of other employee rights in the event of transfer (such as prohibition of dismissal), and stipulates duty of transferor and transferee to inform employee's representatives.
