Consolidates the law on bankruptcy. Part One provides preliminary definitions. Part Two deals with Proceedings from the Act of Bankruptcy to discharge, sets out the legal defintion of bankruptcy, procedures on receiving orders and the effects of a receiving order. It makes explicit proceedings consequent on the making of a receiving order against a debtor. Establishes procedures on the public examination of a debtor, compositions and schemes of arrangement, adjudication of the bankruptcy and the appointment of a trustee, and control over the person and property of a debtor. Part Three sets out regulations on the administration of property. It makes provisions on proof and priority of debts, property available for the payment of debts, the effect of the bankruptcy on antecedent and other transactions and on the seizure and possession of property. It also includes regulations concerning the sale of real estate and the distribution of property. Part Four concerns the status and duty of an official assignee. Part Five concerns the role of trustees in a bankruptcy. This includes duties of the trustee, discretionary powers, vacancies of trusteships and procedures and conditions on the removal or release of a trustee. Part Six sets out provisions on the jurisdiction, procedure and powers of the High Court. Part Seven defines how the Act is to be applied to specific cases. Part Eight concerns supplementary regulations on, inter alia, evidence, the death of a debtor, wife or witness and on unclaimed and undistributed funds or dividends. Finally, Part Nine deals with offences committed by the bankrupt and the trial and punishment for such offences.
