Privatization is defined as the sale of State property by its owner, the State, to private owners who may include Kazakh and foreign individuals and companies. In order to prevent renationalization of privatized State property, the decree prohibits companies in which the State owns more than 20 percent of the shares from participating in the process of privatization. Transparency and competition are the basic principles of the privatization process. The principal privatization methods include auction, tender and direct sale. Disputes arising from the privatization process are subject to the jurisdiction of the Kazakh courts.
